Privacy Notice 

Your privacy is very important to us, and you can be confident that your personal information will be kept safe and secure and will only be used for the purpose it was given to us. Orange Zebra adhere to current data protection legislation, including the General Data Protection Regulation (EU/2016/679) (the GDPR), the Data Protection Act 2018 and the Privacy and Electronic Communications (EC Directive) Regulations 2003


You have a legal right to be informed about how we ‘Orange Zebra’ use any personal information that we hold about you. To comply with this, we provide a ‘privacy notice’ to you where we are processing your personal data. 


This Privacy notice for Orange Zebra ( “we”, “us” or “our”) describes how and why we might collect, store, use and/ or share (process) your information when you use our services.


We, Orange Zebra, are the ‘Data Controller’ for the purposes of data protection law. Subcontracted therapists process data following Orange Zebra data protection policy and their HCPC obligations. All therapists are self-employed and contracted to deliver therapy services on behalf of Orange Zebra, they are also individually registered with the ICO.


Who we are

Orange Zebra consists of a small number of HCPC registered therapists offering creative therapies such as art therapy or dramatherapy. Whilst all therapists work on a self-employed contractor basis, they all adhere to Orange Zebra data protection policy. All therapists are individually registered with the ICO 


The personal data we hold 

We hold some personal information about you to be able to offer therapy services to you/ your child/ a young person in your care. 


When you contact us with an enquiry about our therapy services, we will collect information to help satisfy your enquiry. This will include but is not restricted to: your name, email, telephone number, your child’s name, school/college/university attended, home location and a brief reason for your enquiry. 


A GP or other health professional or parent might make a referral on behalf of a young person, this will always be made with the young person’s consent and by making contact you are confirming you have obtained consent. 


If you decide not to use our services, we will ensure all personal data relating to your initial contact is deleted as soon as possible and within 3 months. If you would like us to delete this information sooner, just let us know. The personal data we collect will never be sold or passed on to another organisation or person.


Personal data that we may collect, use, store and share (when appropriate) about you includes, but is not restricted to: 

  • Parent(s) Caregiver Name/ Child/Young Persons Name
  • Parent Contact Details/ Contact Details
  • Child/Young Persons Date of Birth
  • School/College/Sixth Form/ University Name
  • Brief Reason for Enquiry


We may also collect, store and use information about you/ your child/ a child in your care that falls into "special categories" of more sensitive personal data. This may include but is not restricted to: 

  • Ethnicity
  • Characteristics ( for example are they reserved, confident, impulsive)
  • Child Development History (such as pregnancy, birth, milestones, behaviour, relationships)
  • Health (such as physical health, health conditions)
  • Allergies
  • Medical Diagnosis (such as Autism or ADHD)
  • Education needs ( for example does your child have an EHCP)
  • Information on how the child functions in areas such as sleep, eating, social engagement, managing emotions, levels of stress.
  • Parent/caregiver history including any significant experiences/ bereavements/ mental health. 
  • Hopes for the therapy/aims.
  • Child/young persons interests / resources/ things that support them.
  • More in-depth descriptions around your reason for referral 


We may also hold data about you/ your child that we have received from other organisations, including schools and social services if the referral is made via the local authority or via school (with parental consent). 


When Orange Zebra receives a referral, the person completing it confirms that they already have the child/young person’s/parental consent. That data will be stored even if we do not go on to work with the referred person. This data will be deleted within three months. Why we use this data 

We use this data to provide therapy services which may include using data to: 

  • Communicate with parents / service user via email, telephone, text message.
  • Setting up an initial assessment
  • Completing a consent form
  • Form therapy reports (upon your request)
  • Look after your wellbeing 
  • Provide suitable therapeutic provision
  • Match your child/ a young person with an appropriate therapist
  • Form therapeutic recommendations
  • Setting Aims/ Review Aims
  • Record attendance to therapy sessions


Our legal basis for using this data 

Our lawful bases for collecting or using personal information to provide and improve products and services for clients are:

  • Consent - we have permission from you after we gave you all the relevant information. All your data  protection rights may apply, except the right to object. To be clear, you do have the right to withdraw your consent at any time.
  • Contract – we have to collect or use the information so we can enter into or carry out a contract with you. All of your data protection rights may apply except the right to object.
  • Legal obligation – we have to collect or use your information so we can comply with the law. All of your data protection rights may apply, except the right to erasure, the right to object and the right to data portability.


Where we get personal information from

  • Directly from you
  • From school or the local authority ( if a referral is made by school or the local authority with your consent)

We will only collect and use your information when the law allows us to. Most often, we will use your information where: 

  • We need to comply with the law
  • The child/young person or parents/carers have given us permission to use it in a certain way 
  • We need to protect the child/young persons/your interests (or someone else’s interest) 
  • Where we have got permission to use your data, the child/young person or parents/carers may withdraw this at any time. We will make this clear when we ask for permission and explain how to go about withdrawing consent. 


Some of the reasons listed above for collecting and using your information overlap, and there may be several grounds which mean we can use your data. 


Collecting this information 

While in most cases the child/young person/parents/carers, must provide the personal information we need to collect, there are some occasions when the young person can choose whether to provide the data. How we store this data 

We will keep/store personal information about you/your child while you are receiving services via Orange Zebra. A therapist will complete an initial assessment with parent(s)/caregivers to prepare for any therapy services. The information gathered in initial assessment is strictly used ONLY for the purposes of forming therapy recommendations, setting aims, and to provide therapy sessions/services. The assessment information will be shared with the allocated therapist, it will not be stored by the allocated therapist, this information is held securely by Orange Zebra. The information will not be used for any other purposes and will not be shared with any other third party.  The data collected in the initial assessment is deleted when we finish working with you. We keep a brief record of attendance for administration purposes which contains no personally identifiable information, we use a client code and save this in an encrypted format. We only keep data that is necessary, where we are required to by law and therefore anything that is deemed ‘not necessary’ is deleted when we finish working with you. 


Your therapist will create and store minimal clinical notes, they will store them securely in line with Orange Zebra Data protection policy and in line with their HCPC guidelines and ICO registration. If you want to receive a copy of the information that Orange Zebra hold please contact: office@orange-zebra.uk, or if you would like a copy of your therapists clinical notes please email your therapist directly with your request. If you do not have your therapists contact details, please email: office@orange-zebra.uk and we will send you your therapists contact details to support you with your request. Please be aware that when you sign your consent form you are agreeing to a 'healthy degree of privacy' in regards to your child's therapy sessions.


Data sharing 

We do not share personal information about you/your child with anyone outside Orange Zebra without permission from the young person or parents/carers unless the law and our policies allow us to do so. Where it is legally required, or necessary for another reason allowed under data protection law, we may share personal information about you with: 

  • Local authority – to meet our legal duties to share certain information such as concerns about a young person’s safety/safeguarding concerns. 
  • Our registered bodies such as HCPC
  • Health authorities 
  • Police forces, courts, tribunals 
  • Health and social welfare organisations 


What Cookies Do We Use and What For?

Our Site may place and access certain Cookies on your computer or device. First party Cookies are those placed directly by us and are used only by us. We use Cookies to facilitate and improve your experience of our Site and to provide and improve our services.

Your rights 

How to access personal information we hold about you/your child


You can find out if we hold any personal information about you, and how we use it, by making a ‘subject access request’. If you want to receive a copy of the information that Orange Zebra hold please contact: office@orange-zebra.uk, or if you would like a copy of your therapists clinical notes please email your therapist directly with you request. If you do not have your therapists contact details please email: office@orange-zebra.uk and we will send you your therapists contact details to support you with your request. 


Your other rights over your data 


Your right of access

You have the right to ask us for copies of your personal information. This right always applies. There are some exemptions, which means you may not always receive all the information we process. 

Your right to rectification

You have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete. This right always applies. 

Your right to erasure

You have the right to ask us to erase your personal information in certain circumstances.

Your right to restriction of processing

You have the right to ask us to restrict the processing of your information in certain circumstances. 

You have other rights over how your personal data is used and kept safe, including the right to: 

  • Say that you don’t want it to be used if this would cause, or is causing, harm or distress 
  • Stop it being used 
  • Have it corrected, deleted or destroyed if it is wrong, or restrict our use of it 


Complaints
